AIvatar provides AI-powered avatar and digital human solutions for businesses, including:

• Digital Human Platform: Lifelike AI avatars for customer service and support
• AI Avatar Asset Management: Comprehensive virtual asset management and maintenance
• Enterprise AI Agents: Custom industry solutions and AI-powered automation
• API Access: Programmatic access to avatar generation and management services

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use or security breach

3.2 Account Requirements

• You must be at least 18 years old or the legal age of majority in your jurisdiction
• You must have the authority to enter into binding contracts
• Each user may only maintain one active account

3.3 Password Requirements

For your security, passwords must be at least 8 characters long and contain at least one uppercase letter, one lowercase letter, and one number. We strongly recommend using a unique password and enabling two-factor authentication.

4. Subscriptions and Payments

4.2 Payment Terms

• All fees are quoted in US Dollars unless otherwise specified
• Payments are processed securely through our payment providers
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time through your account settings

4.3 Refunds

5. Acceptable Use

5.1 Prohibited Activities

You agree not to use our Service to:

• Create avatars that impersonate real individuals without their consent
• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Infringe upon intellectual property rights of others
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems
• Use the Service in any way that could damage, disable, or impair our infrastructure
• Violate any applicable laws or regulations

5.2 Usage Limits

Your subscription plan includes specific usage limits (API calls, avatar generations, storage, etc.). Exceeding these limits may result in additional charges or temporary service suspension.

6. Intellectual Property

6.1 Our Intellectual Property

AIvatar and its licensors own all rights, title, and interest in and to the Service, including all software, algorithms, designs, logos, trademarks, and trade secrets. These Terms do not grant you any rights to use our intellectual property except as necessary to use the Service.

6.2 Your Content

You retain ownership of any content you upload to our Service (images, videos, voice recordings, etc.). By uploading content, you grant us a limited license to use, process, and store such content solely for the purpose of providing the Service to you.

7. Content and Avatar Usage

7.1 Avatar Ownership

AI avatars created using our Service are your property, subject to the following:

• You are responsible for ensuring you have the necessary rights to use any source material
• You may not create avatars of real individuals without their explicit consent
• We retain the right to use anonymized avatar data for service improvement

7.2 Generated Content License

You are granted a perpetual, worldwide, royalty-free license to use content generated through our Service, subject to these Terms and your subscription plan limitations.

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the use of the Service. This obligation survives termination of these Terms.

9. Termination

9.1 By You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service immediately ceases.

9.2 By Us

We may suspend or terminate your account if you violate these Terms, with or without notice. In case of termination for cause, no refund will be provided.

9.3 Effect of Termination

Upon termination:

• Your access to the Service will be disabled
• We may delete your data in accordance with our Privacy Policy
• Any outstanding fees remain due and payable
• Sections that by their nature should survive termination will continue to apply

10.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIvatar SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10.3 Maximum Liability

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Sending an email notification for significant changes
